Legal actions to be taken if the neighbours tree is a nuisance to our house

 

           Today I would like to inform you about legal action to be taken if the neighbor’s  tree is a nuisance to our house. It is a very common problem.  Leaning a neighbor’s tree into our house is a common problem. It often becomes a threat to our home.This can be harmful to the life and property of the home.

         In such cases,it is necessary to submit a complaint to the panchayat member  or the residence association. That way we can solve problems easily. 

       These problems are less likely to be resolved this way.That time,we have to deal with it legally.As per kerala panchayat  Raj act 238, if a tree or its branch or fruit threatens or causes damage to another’s life ,property or crops,against  the owner of the house has the right to take legal action.

       Similarly legal action can be taken under the disaster management act. The cost of taking legal action may be borne by the person responsible.

          The panchayat will take legal action if the leaves of the next house tree fall and  contaminate the well water or obstruct public transport. If the panchayat does not take action when we give a complaint,we can file a complaint before the subdivision magistrate.
